"International Online Arbitration Court": Innovation engine for IT Security Products
Sefirot is well underway with the innovative project named the "International Online Arbitration Court". After successfully specifying the system-internal sequences great progress has been made. The project will translate all possible procedural events of an ordinary court into a widely automated, highly secure Internet-based reference court system; to introduce a multiplicity of IT security products is part of the effort.
Given the practical and juridical boundary conditions the requirements of a totally qualified and user friendly Online Arbitration Court were analyzed and subsequently specified. It was found that employment of a multiplicity of very powerful application modules and tools was mandatory. Sefirot's generic system approach resulted in the need of developing a powerful formal language right from the start. This tool is not only useful for secure Online Arbitration Court systems; a separate paper will be issued for it. 
The future employment, the adaptation and the development of critical IT security products had to be visualized; the various independent states of an Online Arbitration Court and/or mediation procedures provided the frame. Analyzing the requirements thusly derived had far reaching consequences for the type and practicality of system components. One should distinguish within the arbitration complex:
The information phase: potential customers (parties) will receive briefings about the functional aspects and advantages of an International Online Arbitration Court. A conventional web appearance or respective supplemental inputs at web pages of Internet shops, assurances, banks, etc was considered.
The acquisition phase: potential customers of the International Online Arbitration Court negotiate online the conclusion of arbitration agreements (§§ 1029 ff ZPO). Aside from juridical forms the support part of the International Online Arbitration Court offers easy to handle never the less extremely stable signature-, verification- and crypto modules. A high degree of authenticity and data security is assured. As aid for the customer strong demands re security, standard conformance, interoperability and handling ease were posed for IT products to be employed. The Sefirot competence center guarantees total quality tests such that customers ordering security products can rely upon their security and proven quality.
Agreement to arbitrate; conclusion phase: the effective conclusion is essential for binding the parties by their promise to carry out a potential conflict at the Online Arbitration Court. If consumers are participating it is a compulsory legal requirement (§ 1031 Abs. 5 ZPO) either a hand signed or a qualified electronic contract signature (§ 2 Ziff. 3 SigG ) is required. Components required for secure signatures (Smart Cards, PIN pads with secure PIN injection for signature generation, verification modules) and quality assured by the Sefirot competence center will be delivered to the customer. Still comfort with application efforts and interoperability are firm features.
Filing a suit: FAS-phase: it is strongly recommended to employ qualified electronic signatures for the online submitted statement of case. IT security products like signature application components, crypto modules and time stamp services encompass the customary quality characteristics.
Hot court procedure phase. Some examples of security components: Qualified electronic signatures for all court procedural states/papers, automated schedule control, secure doc- archiving and processing, crypto modules, Smart Card logon modules for protected doc access by arbiters.
Decision phase: arbitrage and amicable settlement, presently the exception for juridical and practicality reasons, are produced additionally with handwritten signature by the arbiter
Court cost/payment phase: paying the court fees will be done by online banking. The Sefirot construct to utilize the same electronic signature Smart Card for banking purposes is of interest.
The "International Online Arbitration Court" project is offering great chances for manufacturers of security products. It is also a challenge to participate in developments that will produce new impulses on the IT security market re standard conformance, interoperability and practicality of products.
